1. Eligibility and Acceptance

1.1 You must be 18 years or older and legally competent under the Indian Contract Act, 1872.

1.2 By using the Platform, you represent that you meet these criteria or are authorized to act for a legal entity.

1.3 Continued use constitutes acceptance of these Terms and any future updates.

2. Scope of Agreement

These Terms govern:
● Use of our website and digital properties.
● Purchase, payment, and delivery of Vilaav Homes products.
● Participation in any offers, customization services, or designer collaborations.

All other policies (Privacy, Return, Warranty, Shipping) form integral parts of this Agreement.

3. Permitted Use of the Platform

3.1 Use only for lawful purposes.

3.2 You must not:
● Upload or share content that is defamatory, obscene, infringing, or unlawful.
● Attempt unauthorized access, disrupt servers, or introduce harmful code.
● Copy, reuse, or sell site content without written consent.

3.3 Violation may result in suspension, termination, or legal action.

4. Account Registration and Security

4.1 Some features require account creation. Provide accurate and updated details.

4.2 You are responsible for safeguarding your credentials and all activity under your account.

4.3 We may suspend or delete accounts with false, incomplete, or abusive data.

5. Product Information and Representation

5.1 Products displayed are handmade and may vary slightly in texture, color, or finish.

5.2 Dimensions are approximate; minor variance is acceptable in artisanal production.
5.3 Material details, finishes, and usage guidelines are provided in good faith.
5.4 Vilaav Homes reserves the right to update or discontinue any product without prior notice.
5.5 All imagery and digital renders are for visual representation only.

6. Pricing and Payment Terms

6.1 Prices are in Indian Rupees (₹) and inclusive/exclusive of taxes as displayed.
6.2 We accept secure online payments via approved gateways.
6.3 Orders are confirmed only after payment authorization.
6.4 We reserve the right to cancel orders due to stock unavailability, pricing errors, or suspected fraud (store credit or full refund if applicable and approved in writing by Vilaav Homes).
6.5 Bulk or customized orders may follow milestone-based payments, communicated separately.

7. Custom and Bespoke Orders

7.1 Custom furniture is built to your specifications and begins production after design and payment confirmation.
7.2 Once production starts, cancellation, return, or modification is not allowed.
7.3 Customers must verify all measurements, finishes, and design approvals prior to confirmation.
7.4 Minor material or finish variations inherent to handcrafted work shall not constitute defects.

8. Shipping, Delivery & Risk Transfer

8.1 Estimated timelines are communicated during checkout; actual delivery may vary.
8.2 Standard doorstep delivery is complimentary unless otherwise noted.
8.3 Optional “White Glove Delivery” (assembly + placement) may incur additional charges.
8.4 Risk of loss passes to the customer once the product is delivered and signed for.
8.5 Inspect packages upon delivery; report visible damage within 24 hours.
8.6 Delays caused by transport strikes, natural disasters, or unforeseen events are not grounds for claim. Vilaav Homes will inform you promptly of any unavoidable delay.

9. Returns, Replacements & Refunds

9.1 Returns accepted only for defective or damaged products reported within 24 hours.
9.2 Eligible items must be unused, in original packaging, and accompanied by proof of purchase.
9.3 Custom or made-to-order furniture is non-returnable and non-refundable.
9.4 After inspection, Vilaav Homes may offer replacement, repair, or store credit only.
9.5 Approved refunds are processed as store credit within 7–10 business days.

9.6 A full monetary refund may be given only if explicitly approved in writing by Vilaav Homes officials.
9.7 Improper handling, moisture exposure, or misuse voids eligibility.

10. Warranty Policy

10.1 All Vilaav Homes products carry a limited warranty of 6 months from delivery, covering manufacturing defects only.

10.2 Coverage: manufacturing or material defects in woodwork or joinery.
10.3 Exclusions: normal wear, exposure to sunlight/moisture, upholstery fading, intentional 

damage, or third-party repairs.
10.4 Warranty claims require photos, invoice, and written complaint.
10.5 The Company’s decision on repair, replacement, or rejection is final.

11. Cancellations

11.1 Orders can be canceled within 24 hours of placement if production or dispatch has not started.
11.2 No cancellations after fabrication begins for custom orders.
11.3 Company-initiated cancellations (e.g., stock or logistics issues) result in store credit or full refund if authorized in writing.

12. Intellectual Property Rights

12.1 All content, designs, logos, text, images, and code are owned or licensed by Vilaav Homes.
12.2 Unauthorized use, duplication, or distribution is prohibited.
12.3 Collaborating designers remain bound by separate IP and royalty agreements.
12.4 Trademarks “Vilaav Homes” and associated visuals are protected under applicable Indian laws.

13. User-Generated Content and Reviews

13.1 By submitting reviews, photos, or feedback, you grant Vilaav Homes a non-exclusive, royalty-free, worldwide license to use and display such content for marketing.
13.2 You confirm ownership of submitted content and that it does not infringe third-party rights.
13.3 We may remove or edit content violating these Terms.

14. Website Usage and Conduct

14.1 You must not upload malicious code, scrape data, or disrupt website performance.
14.2 Do not attempt to bypass payment systems or security layers.

14.3 We may restrict access or disable accounts for suspicious or abusive activity.

15. Limitation of Liability

15.1 To the maximum extent permitted by law, Vilaav Homes is not liable for:
(a) Indirect or consequential damages.
(b) Loss from third-party delays or acts of nature.
(c) Business interruption or data loss.

15.2 Our total liability shall never exceed the price paid for the concerned product.

16. Disclaimer of Warranties

16.1 Except where expressly stated, all services are provided “as is” and “as available.”
16.2 We disclaim implied warranties of merchantability, fitness, or non-infringement.

17. Privacy and Data Protection

17.1 Personal data collected during browsing or checkout is processed per our [Privacy Policy].
17.2 We do not sell or misuse customer data.
17.3 We employ SSL encryption and industry-standard security protocols.
17.4 User agrees to provide accurate information for communication and invoicing.

20. Indemnification

You agree to indemnify and hold harmless Vilaav Homes, its employees, and partners against any claims, losses, or damages arising from misuse of the Platform, breach of these Terms, or violation of law.

21. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
All disputes are subject to the exclusive jurisdiction of the courts at Jodhpur, Rajasthan.
Parties shall attempt amicable resolution before litigation.

22. Amendments and Updates

Vilaav Homes may revise these Terms periodically. Updated versions take effect upon posting on the Platform.
Continued use constitutes acceptance of the updated Terms.

23. Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

24. Entire Agreement

These Terms, together with referenced policies, constitute the entire agreement between you and Vilaav Homes regarding your use and purchases.
